Taking interest is a very big sin, as it is written in the
portion of Behar – אל תקח ממנו נשך ותרבית ויראת מאלוקיך
The word used is noshech – literally means one who bites. This
is similar to the bite of a snake, which bites a person on his heel
and slowly the venom reaches his head. At first, he does not feel
the sting but eventually it is enough to kill him. So too, with
interest. When one takes a loan with interest, at the beginning he
does not realize what a heavy price he has to pay. Slowly, slowly
it builds up and each month the price becomes higher and eventually
he feels that he is sinking in debt
.All those who are involved in the business transaction is
responsible for the act. They are all punished if there is interest
involved. There is no difference between one cent and a larger
amount of money. The sin is only concerning loans to one of the
Yiden, It is permissible to take interest from a non-Jew. The
Midrash tells us that one who takes interest on loans is comparable
to one who denies his belief in Hashem, in taking us out of
Mitzrayim. Therefore, the end of the pasuk is – I am Hashem who
took you out of Mitzrayim. He takes upon himself the burden of the
Heavenly Kingdom, ol malchus shamayim. It is considered as if he
admits and accepts the fact that Hashem took us out of Mitzrayim
and He is the One who nurtures each of us. He sustains each of us
so the individual person does not have to look for any deceiving
ways to make more money.
The earnings we receive is compared to an investment that
Hashem gives each one. If he uses it properly, there is a bracha,
and the same is true in the reverse. It is not really his own
money. In other words, everything in this physical arena, as we
know it, belongs to Hashem. David Hamelech says in Tehillim 24:1 –
to Hashem is the earth and all that fills it. At the same time,
Hashem promised to sustain all creations. The set-up is that He
grants all creations their needs. He gives each one as much as he
needs to live. If there is one who thinks otherwise, then the trust
in the Omnipotent is failing. He is 'in charge' and trusted to use
the money he receives honestly. Hashem will give him whatever he
needs to make a living. This is one of the explanations of saying
the first bracha after eating bread to this very day, even though
initially Moshe Rabbeinu instituted this bracha thanking Hashem for
the manna each day
How appropriate for this mitzvah to be written in the
portion speaking of shemittah and yovel.
A further point, if he really believed that Hashem tends to
all his matters, and gives him whatever he truly needs, then he
would not worry and seek sly ways to make more money. If he lacks
this basic trust in Hashem then he is denying the fact that Hashem
released us from Mitzrayim and cannot support him. The one who
claims that the money earned is mine to use in whatever manner I
choose, is limiting his resources to natural means. For this
reason, he may take interest from a non-Jew. Only the Yiden live a
super-natural life. The other nations live according to natural
means so taking interest is addressing them on their terms.
One who takes interest does not become resurrected for he does
not live his life on a super-natural state. This will clearly be a
visible miracle. Yechezkel says – בנשך נתן ותרבית לקח חייו לא
יחיה... Yehoram who borrowed Ovadya money with interest was killed.
Ovadya was not punished because he did it to support the prophets
who were in a life-and-death situation. There was pikukach nefesh
involved so he was exempt of this punishment.
Hashem says – why don't you learn a lesson from the solar
system which I supervise and conduct since creation? One does not
take anything from the other with interest. During the winter
months till the summer the night 'loans' hours from the day and
during the summer months the sun 'loans' hours from the winter long
nights. And you, people, want to give money to the other person and
yet benefit from it? It is as if one says to Hashem, why don't you
take interest from the sustenance You give us, from the trees I
grow, the food You give, the light You give each day, the soul You
grant us each day, the body? After I see that you take interest on
a loan you give, then I will not take any interest, I will take the
basic amount, the life, the neshama and not return it to you when
Moshiach comes.Some people claim that if I won't take interest,
then I will end up so poor I will have to beg for alms. What a
perverted way of looking at life. A true pity for those and their
souls.Interest is any form of benefit, whether monetary or
otherwise.•
One is forbidden to earn money in any form on the account of
giving tzedakah to widows and orphans. For instance, one says –
take 500 shekels and half goes to the widow and orphans and the
other half you can invest to enlarge the basic amount. If the
business deal falls through, then at least the widow and orphans
received their share.•
One is forbidden to have any benefit from produce (not only
money) that is entrusted in his ownership in exchange for a loan.
For instance, if one borrowed 100 kilos of wheat and is told – you
can use my apartment, or store or garage till I repay you – this is
forbidden.• A hint of interest is when one buys on credit and the
price is not exactly the same when he bought the merchandise and
when he paid for it.• One should be very careful when one borrows
any item of food so the food that he returns is worth exactly the
same amount. Some specifically say that I am taking it as a gift or
pay for it immediately.• Verbal interest – complimenting someone so
that the next day he would ask him for a favor and then he would
feel obligated to comply. Or, giving a donation, bigger than usual
to a shul to get a special aliyah the next week.• One is forbidden
to work for someone in exchange for another job, which is heavier
or harder than the first one.•
One is forbidden to borrow money and in exchange teach his
child Torah till he is repaid, unless he was teaching beforehand.•
All sorts of verbal or emotional manipulation to coerce the other
person in achieving his desires are sorts of interest
.There is an agreement known known as היתר עיסקא – a
permissible mode of business. Most banks have this automatic
agreement whenever taking loans from them. This statement claims
that the individual still has some claim over the money given to
the bank. It does not become the bank's money comple
The Rebbe teaches us (likutey sichos volume 3) the inner
meaning of this mitzvah and how we can observe it today in a
permissible fashion. The Torah tells us that one is forbidden to
take or partake in any way in any form of interest – because I am
your Hashem who took you out of Mitzrayim. From this pasuk, the
Sifri concludes that whoever accepts the mitzvah of interest is
considered as if he accepts the yoke of the Heavenly kingdom. He
who accepts the mitzvah of interest is considered as if he accepts
and admits to the fact that Hashem is the One who took us out of
Mitzrayim and he who denies one – denies the other, too.What is the
connection? Why draw the parallel to this mitzvah more than to any
other mitzvah? Hashem differentiated between the firstborn on the
night of Pesach, so too, Hashem can differentiate between the coin
given to a non-Jew for interest and the coin taken or given to a
Yid. However, this only proves the connection to interest taken or
given to a non-Jew, not to the general command or that money loaned
to a Yid. Some commentaries explain that when one loans money to a
Yid without the possibility of any profit, then he is actually
saying that he trusts in Hashem to be the only One who sustains him
and he does not have to resort to any 'tricks' to get money.
However, the Sifri speaks of ol malchus shamayim and
here it is speaking of bitachon. (Another point, the lack of
bitachon is more related to the degree of gemilas chessed and not
so much of interest or loaning money. If one does not relish the
thought of loaning money, then he is not violating any law (he is
afraid to loan and give away part of his money so he keeps it for
himself. He is not transgressing any sin when he keeps it to
himself.) This is more related to acts of kindness than to interest
on loans.)The expression of kabalos ol is truly in the practical
observance of mitzvahs. אשר 'קדשנו במצוותיו - we are being
sanctified when doing His mitzvahs. These are mitzvahs,
commandments of Hashem. These are acts of Hashem; these are His
performances. Hashem observes all the mitzvahs He commanded us.
Here, there are two factors: a) the desire of doing these mitzvahs,
even before the actual act; and b) the effect of each mitzvahs of
each of the Yiden for Hashem. Each time we learn Torah, Hashem
'reads' after us, Hashem repeats each word we say. It is crystal
clear that this effect our mitzvahs have on Hashem is not truly
effectual. It is only the desire of Hashem that willed to be
effected by our observances.
Why did Hashem want to set up the world in such a fashion?
Hashem has everything, so what can a human being add to someone who
has everything? The first factor, the desire of Hashem to observe
all the mitzvahs, is the potential granted to each of the Yiden to
observe the mitzvahs. Thereby, connecting ourselves to the Infinite
Creator, bonding the Infinite to the finite physical world. Hashem
is the ultimate character and source of kindness, to do goodness to
all beings. Why is there a need for such toil and exertion? The
true kindness and chessed granted to another is when he will
appreciate the kindness and enjoy it to the fullest measure. This
can only be possible if we have a share in making it happen;
otherwise, it is considered shamed bread – earnings we did work
for. When a person toils and earns his wealth, however this work
does not bring any benefit to anyone or anything, then the earnings
are valueless.
The story of the poritz who asked the farmer to move his
hand as though he is chopping wheat stalks, but in his inner
chamber and he will receive a salary for it. After a while, he will
feel totally useless and valueless. If he is chopping wheat, he is
doing the same act but he will earn something after a whole day's
work. Hashem set up the world in such a manner that each one should
exert his energies and also receive a benefit from it. Knowing that
these benefits are even reaching up high to shamayim, will give him
even more encouragement and simcha when observing these
mitzvahs.
The triumph against the yetzer hora will bring an abundance of
nachas to the Creator
!Each mitzvah one observes triggers a 'withdrawal' of
inspiration from Above, so too, in order to draw down this
inspiration – one must exert efforts in his avodas Hashem. This is
interest, meaning, some sort of benefit from a monetary loan. One
receives interest on the account of the fact the money was once his
and now transferred to another person. He allows the borrower to do
business with this amount. Stringency in interest means that one
benefits from monies, which is still in his ownership, it is given
as a security deposit to the other person but is still considered
his money. This is also the basis for 'heter iska' with all the
banks. The 'withdrawal' of inspiration from Above is 'measure for
measure', the way a person conducts his life in the physical arena,
this is mirrored in the spiritual arena. If he takes interest for
money, he owned in the past, that is what Hashem will do too. He
will just receive money for money; he won't receive any partake of
the Above inspiration.
He will only receive that part of participation of
Hashem preceding the mitzvah, the original desire for mitzvahs. And
if he is careful with interest, he continues to feed the mitzvahs
with his own joy and thrill, then the mitzvahs continues to be his
– then Hashem will continue to feed this joy and excitement of a
mitzvah by sharing it with him. If he views a mitzvah as a
potential for benefits of the past, then he will receive only from
the 'past and original' desire from Above. However, if he practices
this observance with much delight and enthusiasm, feeding the
mitzvahs with current energies, then Hashem will reciprocate. This
is the connection between the mitzvah of interest and kabolas ol
and leaving Mitzrayim – Hashem becomes a 'partner' in our daily
lives. One accepts the yoke of heaven,
thereby, leaving the restraints of the natural world.
Thus, he becomes bonded with the Omnipotent Creator. Tzaddikim are
similar to Hashem, - just as Hashem does not create and then leave
the world to nature, He is constantly involved in every detail of
life, when the Yiden observe each of the mitzvahs. Hashem observes
the mitzvahs together with the Yiden. This is true with all
tzaddikim, and particularly with the leaders of the generation, who
are the ממוצע המחבר. These leaders send emissaries to all parts of
the word to do their mission, but they, too, personally partake in
this mission.
The previous Rebbe was an outstanding personal example for
this – he sent out Chassidim to all parts of the world to spread
Torah values and Chassidus. He did the same with great mesiras
nefesh.
The practical message is: don't violate the prohibition of
interest. Don't assume that once you observed mitzvahs, then the
reward is coming to you automatically. One is expected to feed the
mitzvahs with simcha and input, on a daily basis. Do not expect to
reap the benefits of a once-done mitzvahs' continuously. Also,
don't assume that once you helped another Yid with spiritual
gemilas chessed, you can reap the benefits by sitting back and
feeling satisfied. Keep up the work, be in touch, make it part of
your daily routine to have that person part of your security
deposit.
The reward for this is that Hashem will truly take us out of
golus, our personal Mitzrayim with much joy and excitement.The
Rebbe explains in a sicha volume 12 that taking interest from a goy
is permissible and in fact a part of the mitzvah of taking
interest. Hashem created the world and divided the entire planet
for each nation. The first pasuk, Rashi explains that the goyim
will come to complain that we are stealing their area. True, we are
stealing the lights and sparks of holiness in each item we use to
do the mitzvah. Each individual has several sparks to elevate and
purify. Only the Yiden can elevate these parks. Each time we do a
mitzvah, we elevated the spark within that item we used for the
mitzvah. These sparks cannot be elevated by anyone else. The goyim
feel this and come to the Yiden to complain. As soon as the Yiden
conquered the land, it is forever being called Eretz Yisroel, Eretz
hakodesh. This notion cannot never be nullified. The land does
never belong to them as it was before.Money is involved whenever we
do a business transaction. Interest is a question at each
move.
When doing business with a goy, we need those sparks in
the money to elevate. The business deal is proof that something of
the goy belongs to us. However, in the case of a business deal with
a Yid, the money is not allowed to become mine if those sparks
belong to the other person. If a Yid takes interest, then there is
a two-fold damage. A) the money cannot be elevated by him and b)
the other cannot elevate them because the money is by you and not
available to him
.המלווה בריבית - אינו קם בתחיית המתים הרב מרדכי אליהוהתורה
הסמיכה את האיסור החמור של ריבית, למצווה של עזרה ותמיכה בזולת שלא
יפול, וכ"כ בפרשה (כה, לו) "אַל תִּקַּח מֵאִתּוֹ נֶשֶׁךְ וְתַרְבִּית
וְיָרֵאתָ מֵאֱ-לֹקֶיךָ וְחֵי אָחִיךָ עִמָּךְ". ומבאר בעל הטורים את
הסמיכות של הדברים ללמדנו חומר איסור ריבית, שכל מי שמלוה בריבית אינו
חי בתחיית המתים, וז"ל:"וסמיך ליה וכו' רמז שכל המלוה ברבית אינו חי
וכו' נשך בגי' "זה נחש", לעתיד לבוא אין הנחש מתרפא כדכתיב ונחש עפר
לחמו כן הלוקח רבית לא יחיה", עכ"ל.דמי קבורה של מי שלא קם לתחיית
המתיםמספרים על אדם אחד שהיה מלוה בריבית גבוהה ולא היה חס ומרחם על
הבריות. לימים כשנפטר הזמינו את אנשי החברא קדישא, ואמרו להם שאינם
יכולים לקחת אותו לפני שהם שואלים את ראש החברא קדישא. לא הבינו מה יש
לשאול, הרי המת מוטל לפניהם ולא נותר אלא לקוברו. כשחזרו, אמרו שראש
החברא קדישא ביקש ליטול עבור הקבורה של אותו אדם סכום עתק של תתקפ"ד
דינרים. הלכו בני המשפחה לקיסר והתלוננו בפניו שמפלים אותם לרעה.
הזמין הקיסר את ראש הח"ק לשמוע ממנו מדוע הם נוהגים כך. אמר ראש הח"ק,
אדוני הקיסר, אנו מתפללים ומקוים בכל יום שיבוא המשיח, וקבלה ביסוד
אמונתנו שעתידים המתים לחיות, וכל המתים יקומו ויפנו את מקומם כך
שיישאר בית הקברות פנוי ונקי. אבל יהיו כמה מתים שלא יזכו לקום לתחיית
המתים, וביניהם מי שהלוה בחייו בריבית, ואדם זה שעליו התלונה, היה כל
חייו מלוה בריבית ולא הועילו שום הסברים ושכנועים שיחדל מעושק ידיו,
וכיון שכך, הוא ימשיך להחזיק בשטח מקום קבורתו מעבר לזמן של כל עם
ישראל, ועל כן אנו צריכים לגבות עבורו סכום גבוה יותר מכולם. וזוהי
הסמיכות שבפרשתנו, שמי שלא מלוה חלילה בריבית, הוא נקרא "וחי אחיך"
שיזכה לקום בתחיית המתים.חומרת ריביתעל חומרת איסור ריבית אנו למדים
מהגמרא ("î ó ñ' ò") שאומרת שהתורה הוציאה את הריבית בשני לשונות
שונים כדי לחייב את מי שלוקח ריבית בשני לאוים, למרות ששניהם שוים,
וז"ל:"אמר רבא אי אתה מוצא לא נשך בלא תרבית ולא תרבית בלא נשך, ולא
חלקן הכתוב אלא לעבור עליו בשני לאוין".ושואלים התוס':"וא"ת, ולמה
שינה בלשון, לכתוב כספך לא תתן בנשך ובנשך לא תתן אכלך? ויש לומר כיון
שהוצרך שני לאוין אורחא דקרא לכתוב לשון משונה שהוא נאה יותר".כלומר,
שבעצם התורה יכלה לכתוב נשך פעמיים וגם כך היינו לומדים שהלוקח ריבית
חייב בשני לאוין? אלא שהתורה שינתה בלשונה כדי שתהיה לשון נאה.ונראה
לבאר על פי דברי חז"ל, כשקרא פרעה ליוסף לספר לו על חלומותיו, אמר לו
"שמעתי עליך לאמר תשמע חלום לפתור אותו", ומסביר מרן גאון עוזנו
ותפארתנו בעל הבן איש חי ע"ה, שאמר לו פרעה 'שמעתי עליך "לאמר" תשמע
חלום', כלומר שמעתי שאתה מאלה שמפרסמים את עצמך במודעות ובכרוזים
האומרים "אני פותר חלומות" - ואמר יוסף לפרעה, אינני נוהג כך כלל
ועיקר אלא "לאמור בלעדי", אבל אלקים יענה את שלום פרעה". או אז אמר לו
יוסף לפרעה, אתה חלמת פעמיים, "כי ממהר האלקים לעשותו", וזהו גם כמו
שהתורה פעמיים כותבת נשך ומרבית ללמד על חומרת העניין. (ואז התנהל
ויכוח בין פרעה לבין יוסף בעניין קביעת הזמנים והמועדים בדתות השונות,
והוכיח לו יוסף שראש השנה אצל היהודים הוא אמיתי, שכן בנצרות ובאיסלאם
זה תמיד משתנה כי הם קובעים זמנים על פי החמה בלבד) והקשו המפרשים מי
ביקש מיוסף להשיא עצות ולומר "ירא פרעה איש חכם ונבון" וכו', ואומרים
שזה חלק מהפתרון של החלום לומר לו שכיון שהוא מלך, בידיו לנקוט
בפעולות אלו כדי להציל את ארצו (עיין לרמב"ן שם).פעם אמר ראש ישיבת
'פורת יוסף' שפרעה הוא שאמר "ועתה" שבשפה הערבית פירושו "מה עושים
כעת?", ואז אמר לו יוסף "ירא פרעה" וכו'. אני מצאתי פירוש זה בראשונים
והראיתי לו את זה, הוא שמח מאוד ואמר שאם כך, בודאי שפירוש זה נכון
ואמיתי.וכתב הבא"ח, וז"ל:"צריך ליזהר בריבית וכמה לאוין נאמרו בו,
שהמלוה עובר בששה לאוין: הא' לא תהיה לו כנושה, הב' את כספך לא תתן לו
נשך, הג' ובמרבית לא תתן אכלך, כי באמת אין חלוק בין נשך כסף לנשך
אוכל, ולא חלקן הכתוב אלא כדי לעבוד בכל אחד בשני לאוין, והד' אל תקח
מאתו נשך ותרבית, והה' לא תשימו עליו נשך, והששי לפני עור לא תתן
מכשול. והלוה עובר בשלשה לאוין: הא' לאחיך לא תשיך, והב' לא תשיך
לאחיך, ששני לאוין אלו יש בהם אזהרה ללוה ג"כ שלא לגרום למלוה לישוך,
והג' לפני עור לא תתן מכשול. והערב והעדים והסופר עוברים בשני לאוין:
הא' לא תשימו עליו נשך, והב' לפני עור לא תתן מכשול. והסרסור וכל
המסייע בדבר או המורה מקום ללוות או להלוות עוברים בלאו דלפני עור
וכו' (ש"ש ואתחנן אות א', וכ"כ בשו"ע יו"ד סי' ק"ס סעי' א').הקרן
שהלכה לצדקהמסופר על עשיר גדול שהלך לחסידא ופרישא הבבא סאלי זיע"א
ואמר לו שהוא רוצה לתת לו סכום גדול מאד, ואת הכסף הזה יפקיד בבנק
ויגבה מהם ריבית, ואת כל הריבית יתרום לעניים. בענוותנותו שלח הבבא
סאלי את השמש שלו אלי לשאול אותי בענין. עיינתי בדבר מבחינת ההלכה מכל
צדדיה, ואמרתי לשמש שמהדין מותר (עיין לù"ò é" ñé' ÷"ñ סעי' י"ז י"ח),
ומיהו, הוספתי ואמרתי לו, שהבבא סאלי לא יסכים לעשות כן. חזר השמש
ואמר לבבא סאלי 'הרב אליהו אמר שמותר'. שאל אותו הבבא סאלי: מה אמר
הרב אליהו? והשמש חזר ואמר את דברו, ושוב הבבא סאלי שאל אותו: מה אמר
הרב אליהו? אמר לו השמש 'הוא אמר שמותר'. אמר לו הבבא סאלי: ולא אמר
לך עוד? ענה לו, נכון, הוא הוסיף ש'הבבא סאלי לא יסמוך על ההיתר הזה
ולא יעשה מעשה'. אמר הבבא סאלי אם כן הרי שזה העיקר, ומדוע לא אמרת לי
בהתחלה שכך אמר הרב אליהו? (ומנין ידע? אלא רוח אלוקים דבר בו ואמר
דבריו ברוח הקודש) ולא אסכים לעיסקה של העשיר, וכך עשה. הלך השמש
לאותו עשיר ואמר לו שהבבא סאלי לא מסכים. שאל אותו עשיר מדוע? אמר לו
השמש שהוא שאל רב אחד ושמו הרב מרדכי אליהו. לאחר זמן, הגיע אלי אותו
עשיר ושאל אם אני הרב אליהו, ומשעניתי לו שכן התחיל לצעוק: אתה?!
אתה?! אתה?! אתה תחליט בשבילי מה לעשות בכסף שלי?! לא ידעתי בתחילה
למה כוונתו והתפלאתי על ההתפרצות, ומשהזכיר לי את המעשה פניתי אליו
ואמרתי לו אתה?! אתה?! אתה?! אתה תקבע לבבא סאלי מה לעשות?! אתה תעשה
תנאים לבבא סאלי, אינך מתבייש?! נעלב אותו עשיר ואמר לי שאין הוא רגיל
שכך פונים אליו כי הוא עשיר גדול, ואמרתי לו שגם אני עשיר גדול.
הושבתי אותו והסברתי לו מדוע כך אמרתי, התרכך אותו האיש, ובאותו היום
הוא נתן את כל הכסף שחשב לתרום לבבא סאלי, והבבא סאלי באותו היום חלק
את כל הכסף לצדקה, לת"ח ולישיבות.לאחר יומיים בא אותו עשיר ואמר לי
'שמעתי שאתה אומר שהנך עשיר גדול, אבל הרי אתה לא עשיר, ואל תאמר לי
דרשות איזהו עשיר השמח בחלקו'. אמרתי לו אני לא עשיר?! אתה מכיר את
המלון 'קינג דיויד' ומלון 'הילטון' זה שלי, אך כיון שאני רוצה לעסוק
בתורה, מסרתי אותם לאנשים אחרים (וכך אמרתי לו בבדיחה והוא קבל זאת
ברצינותשאלת קמח או סוכר והחזרתםמהדין, אשה ששאלה מחברתה כוס סוכר
וכדו', וחברתה נתנה לה כוס שאינה מלאה עד הסוף, צריך להזהר להחזיר לה
במדויק, שאם תחזיר לה כוס גדושה, זה ריבית כיון שזה דבר קצוב, ובדבר
קצוב יש איסור ריבית (סאה בסאה אסורכיום ישנם ביצים בגדלים שונים (מס'
1, 2 ,3), ואם ביקשה משכנתה כמה ביצים, והיא הביאה לה ביצים מס' 3 שהם
קטנות, יש להזהר להחזיר מאותו הגודל, שאם תחזיר לה ביצים מספר 1 שהם
גדולות, הרי שזה ריבית.כמו כן, אם בקשה ככר לחם מחברתה והיא הביאה לה
ככר לחם שלם, יש להחזיר לה מאותו סוג, שאם תחזיר לה לחם פרוס הרי שיש
בזה ריבית, כיון שמחירו יקר יותר.ולמעשה, כיום שיש שפע גדול, והשאלת
קמח וסוכר אינה נחשבת לדבר יקר, לכן מותר להחזיר לא בצורה המדויקת
ביותר כיון שלא מדקדקים בזה. אבל אם נתנה לה שכנתה סוכר בכוס צר או
קטן, לא תחזיר לה בכוס רחב או גדול, וכן אם הביאה לה פיתה קטנה לא
תחזיר לה פיתה גדולה וכדו' כלומר במקרים שהשינוי הוא גדול יש בזה בעיה
של ריבית (ועיין לבא"ח ש"ש פרשת עקב אות א',ב .הלואה בשקלים צמודה
לדולרפעם היה אסור מבחינה חוקית לאדם פרטי להחזיק דולרים, ולכן אסור
